Evertell Terms of Service

Here's the short version (but please read the full terms below)
- We collect stories and photos from your guests on your behalf. By placing an order, you authorize us to contact your guests for this purpose. You are responsible for ensuring you have the right to share their contact details with us.
- Your guests own what they share. Stories and photos contributed by guests belong to them — they grant you and Evertell the rights needed to create and deliver your book. We never use guest content for any other purpose.
- We want you to love your book. Two rounds of revisions are included. Once you approve your digital proof, we go to print. If we make a mistake, we'll reprint at no cost.
- Timelines matter. We begin outreach up to one month before your wedding and close the book two days after. Your digital proof arrives within two days, and printing ships within two weeks of approval.
- We store your content for 12 months after delivery, then delete it. You can request earlier deletion at any time.
- Payment is due at checkout via PayPal. Disputes go to arbitration under Israeli law.

1. About These Terms
These Terms of Service ("Terms") govern your access to and use of the website, services, and products offered by Dome Commerce Ltd., a company incorporated in Israel, operating under the trade name Evertell ("Evertell," "we," "us," or "our"). By placing an order or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
We may update these Terms from time to time. If we make material changes, we will notify you by email or by a notice on our website. Your continued use of the services following any change constitutes your acceptance of the updated Terms.
2. Our Service
Evertell provides a premium wedding memory book service ("Service"). Upon placing your order, we assign you a personal Story Manager who contacts your wedding guests to collect stories, memories, and photos on your behalf. We handle all outreach, content collection, editing, design, and delivery of your memory book.
The Service is available in two packages:
- Classic ($450): Personal Story Manager, guest outreach, story and photo collection, digital edition, and premium hardcover book with free worldwide shipping.
- Premium ($750): Everything in Classic, plus luxury layflat book, premium fabric cover, foil-stamped names and date, and audiobook of guest voice recordings.
3. Order Process and Timelines
By placing an order, you confirm that you have read and agree to these Terms. Orders are accepted up to two (2) weeks before your wedding date. We begin collecting guest content up to one (1) month before your wedding.
Our delivery timeline is as follows:
- We close content collection two (2) days after your wedding.
- A digital proof of your book will be sent to you within two (2) days after content is closed, for your review and approval.
- Once you approve the digital proof, printing and shipping will be completed within two (2) weeks.
- Standard worldwide shipping is always included at no additional cost.
Additional book copies may be ordered at the time of your initial order at $119 per copy.
4. Guest Outreach Authorization and Privacy
By placing an order, you authorize Evertell to contact the wedding guests you provide on your behalf, via WhatsApp and other communication channels, for the sole purpose of collecting stories, memories, and photos to include in your memory book.
You are solely responsible for ensuring that you have obtained any consents or legal basis required under applicable privacy laws — including but not limited to GDPR if you or your guests are located in the European Union — before providing guest contact information to Evertell. By submitting guest contact details, you represent and warrant that you have the right to share this information with us for the purposes described in these Terms.
Guest content collected through this process is used solely to create your book and is never sold, shared with third parties, or used for any other commercial purpose.
5. Content Ownership and Rights
Your wedding guests retain ownership and copyright of the stories, photos, and other content they contribute. By participating in the Evertell process, guests grant you and Evertell the rights necessary to use their contributions to create and deliver your memory book.
You retain ownership of the final memory book and all materials compiled within it. By placing your order, you grant Evertell a limited, non-exclusive, royalty-free license to use collected content solely for the purpose of designing, producing, and delivering your book.
Evertell will not use your content or your guests' content for marketing, advertising, or any other purpose without your explicit written consent.
6. Data Retention and Deletion
We take your privacy and the privacy of your guests seriously. The following data retention policy applies to all content collected as part of your order:
- All stories, photos, messages, and personal data collected during the production of your book will be retained for twelve (12) months from the date of final delivery.
- After this period, all such content will be permanently deleted or anonymized.
- You may request early deletion of your data and your guests' data at any time by contacting us at support@evertell.co. We will fulfill deletion requests within 30 days.
- Basic order information (name, email, order number, payment record) may be retained for up to seven (7) years for legal and accounting purposes.
7. Revisions and Approval
Your package includes two (2) rounds of revisions to your digital proof. Revision requests must be submitted within five (5) business days of receiving your proof. A revision is defined as changes to text, layout, or design elements. Additional revision rounds may be available for a fee, at our discretion.
Once you provide final written approval of your digital proof, Evertell shall not be responsible for any errors, omissions, or issues that were present in the approved proof. Please review your proof carefully before approving. If an error was introduced by Evertell after your approval, we will reprint at no cost to you.
If we make an error in producing your book that differs materially from your approved proof, we will reprint or provide a refund at no charge to you.
8. Payment
Full payment is required at the time of ordering. Payments are processed securely through PayPal. By completing your order, you authorize us to charge the selected package amount to the payment method you provide.
Prices are listed in USD. The price displayed at the time of your order is the price you will be charged.
9. Cancellations and Refunds
Because we begin work on your order immediately upon booking — including Story Manager assignment and guest outreach planning — we do not offer automatic cancellations or refunds once your order is confirmed.
If you wish to cancel before guest outreach has commenced, please contact us immediately at support@evertell.co. We will review cancellation requests on a case-by-case basis.
We want you to love your book. If you are not satisfied with the final result, please contact us and we will work with you to make it right, which may include revisions or reprints. If Evertell is responsible for a material defect or error, we will provide a reprint or refund at our discretion.
10. Force Majeure
Evertell shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:
- Acts of war, terrorism, or civil unrest;
- Pandemics, epidemics, or government-mandated restrictions;
- Natural disasters, fire, or flood;
- Strikes or labor disputes affecting our suppliers or shipping partners;
- Failures of third-party printing or logistics providers;
- International shipping disruptions or customs delays.
In such cases, we will make reasonable efforts to notify you and fulfill your order as soon as practicable.
11. User Representations and Warranties
By using our services, you represent and warrant that:
- You are at least 18 years of age;
- All information you provide is truthful and accurate;
- You have the legal right and authority to authorize us to contact your wedding guests on your behalf;
- You have obtained all necessary consents required under applicable privacy laws before sharing guest contact information with us;
- Your use of the services does not violate any applicable law or regulation;
- You will not submit any content that is unlawful, defamatory, offensive, or that infringes the rights of any third party.
12. Intellectual Property
Evertell and the Evertell logo are trademarks of Dome Commerce Ltd. All content on our website, including design, text, graphics, and software, is the property of Dome Commerce Ltd. and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use any trademark, service mark, logo, or trade name of Evertell.
13. Privacy
Our collection and use of personal data is governed by our Privacy Policy, available on our website. By using our services, you consent to the collection and use of your data as described in the Privacy Policy.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERTELL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL, EVEN IF EVERTELL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL EVERTELL'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR YOUR ORDER.
Evertell is not responsible for delays or quality issues caused by guests failing to respond, incorrect contact information provided by you, force majeure events, or circumstances beyond our reasonable control.
15. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EVERTELL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. EVERTELL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
16. Dispute Resolution
16.1 Informal Resolution
Before initiating any formal dispute, you agree to contact us at support@evertell.co and give us a reasonable opportunity — at least 30 days — to resolve the issue informally.
16.2 Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel.
16.3 Class Action Waiver
YOU AND EVERTELL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
17. Termination
Evertell reserves the right to suspend or terminate your access to the services at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.
18. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Evertell regarding the subject matter herein. Evertell may assign these Terms without your consent. You may not assign these Terms without our prior written consent.
Failure by either party to enforce any provision of these Terms shall not constitute a waiver of that party's right to enforce such provision in the future.
